Tour Guides Machupicchu:

Tour Guides Machupicchu, at the present also known as Company, wants you to enjoy your holidays successful. Please read the following conditions carefully as it is your contract with us. When booking a trip with Tour Guides Machupicchu, you agree to be bound by these Terms and Conditions that are described, among other things, our cancellation policy and certain limitations of liability. These Terms and Conditions affect your rights and designate the applicable law and forum for the resolution of any dispute.

The quote given by us will be valid for 90 days from the date of your first investigation. If you have any questions about your holiday, the booking procedure or the conditions of sale contact us and we will answer you with pleasure. Budgets do not apply to international flights to and from South America or South America itself. These quotes are often valid for a short number of days and sometimes a single day. Once you have settled on a flight, the flight must be paid immediately and buy on that day or if possible the next day to ensure the validity of the appointment.

Our prices do not include international airfares to South America, international airport taxes, meals not specified in your itinerary, personal expenses, personal insurance, tips and hauling luggage.

1.- The contract

The contract is between Peru Ver (also known as the Company) and the customer, whether traveling or intending to travel on a tour operated by the company. You, the client is subject to have read and understood our travel policy as follows. When booking by phone, or through the website or by email or fax to the Company or its agents, you agree and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the client in relation to this matter, and will constitute a binding agreement. No oral or written representation, of warranty, collateral agreement, prior agreement, description of the services, or conditions, other than those contained herein. The service to be provided is / are the tour (s) mentioned in the confirmation email.

These conditions only apply to services in our program and not to international and domestic flights. These are subject to the conditions imposed by the airlines.

2.- Secure booking

To secure a booking, tour guides requires a fully completed booking form (either the one on our website or sent by us with your quote) together with the required payment. Customers are deemed to have read and understood the conditions of sale, and have indicated that they have chosen the appropriate response on the booking form. A booking is accepted and becomes definite only from the date on TOUR GUIDES MACHUPICCHU sends a written acknowledgment (once we receive the payment) in what extent there is a contract TOUR GUIDES  MACHUPICCHU reserves the right to refuse any booking at its discretion.

3. Customer Details

For the company to confirm and guarantee the Clients travel arrangements the Client must provide all client details with the initial payment or, not later than 60 days before the beginning of the tour, last minute bookings excluded. If the client does not provide all client details within 60 days before departure, a fee of $ 50.00 will be charged in the file. In the event where the details of the client have not been received by the Company 30 days prior to departure customers, the Company reserves the right to treat the file as canceled and apply sanctions fully. Client details include passport number, copy of passport details and medical form (if applicable), full name, date of birth and nationality.

4. Final payment / Surcharges

The final payment was received the local payment in U.S. dollars in cash upon arrival in Lima on Day 1 of your tour. In the case of non-payment of this local payment, DISCOVERY MACHUPICCHU cancel your booking and cancellation charges will apply (see 8.Cancellation by you).

Surcharges

Prices remain valid for 90 days from the date of your first investigation. If we receive full payment on or before the initial 10 days of our budget, we do not warrant charges.

TOUR GUIDES MACHUPICCHU reserves the right to increase the tour cost to take into account the following items: government actions, currency fluctuations, transportation costs (including the cost of fuel), airport charges and an increase in regular air rates. TOUR GUIDES  MACHUPICCHU will absorb a sum, equal to 2% of the tour cost, in case of being necessary a surcharge. This does not apply to government taxes, imposed after publication of our programs, insurance premiums and amendment charges. The customer will have to pay any sum in excess

Of This 2%. If the surcharge results in an increase of more than 10% of the tour cost, government taxes and extra charges, the customer may cancel the booking within 7 days of notification of the payment and get a full refund. You will be notified of any established surcharge, no more than 4 weeks before your depart.

Local (ground) Payment

All our tours involve a local payment. This amount is the final payment for your tour. Local Payment USD cash, and should be made payable to our representative on day 1 of your trip on arrival in your accommodation. Information on local payments is outlined with the price in your quote, website, travel dossier and all our bills. The local payment is non-refundable and is considered part of the total tour payment.

5. If you change your reservation

An administration fee of U.S. $ 50 per person will be charged if a confirmed booking is changed or transferred to a different departure date or tour, up to 60 days before departure. Thereafter all changes will be treated as cancellations and payment as follows (see 8.Cancellation by you).

If a client is unable to travel, in circumstances that Peru considers Check reasonable, then the booking might be transferred to another suitable person, however the tour arrangements must remain the same and if all suppliers (including airlines) of agree to accept the change of the name. If the transfer is allowed then an administration charge of U.S. $ 50 per person will be made if the company is notified up to 60 days before departure or U.S. $ 100 per person if it is less than 60 days, plus additional charges levied by our suppliers.

6. Changes

(A) Changes made by the Company: The Company reserves the right to change any of the facilities, services or prices described in the brochure or website before booking. If such a change is made, the customer will be informed at the time of booking or when the change occurs. While the Company will endeavor to operate all tours that the mentioned changes, reasonable in the itinerary may be made where deemed necessary or advisable by the Company. If the company makes a major change the Company will inform the Customer as soon as reasonably possible if there is time before departure. The definition of a major change is considered a change affecting at least one day in five of the itinerary. A major change does not apply to the carrier, transport or accommodation name. DISCOVERY MACHUPICCHU is not responsible for changes in flight schedule or departure airport, as this is the responsibility of the airline If the major change is due to force majeure not compensable. When one of the main changes is made the customer can choose between accepting the change, get a full refund of all the quantities paid or accept any alternative tour offered by the company along with compensation as indicated.

In condition that the major change is not the result of situations beyond the control of Peru Ver or consolidation;

The compensation shall be paid as follows:

period of notification assigned by more than 42 days: No compensation

  • 41-28 days: $ 30 (£ or equivalent) per person
  • 27-14 days: $ 40 (£ or equivalent) per person
  • 13 days to the date of travel: $ 50 (£ or equivalent) per person.

DISCOVERY MACHUPICCHU will not pay compensation if you are forced to cancel or change your tour because of war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, epidemics or risk health, technical or maintenance problems with transport, closed or congested airports or ports, changes imposed by rescheduling or cancellation of flights by airlines, the alteration of airlines or aircraft types, or similar events out of the control view

7. Cancellation by the Company

DISCOVERY MACHUPICCHU reserves the right to cancel any trip before it is guaranteed to run, but not cancel a tour less than 60 days before departure. A trip is guaranteed to run once there is a fully paid traveler, unless the minimum number indicates the opposite. This applies to the outlets within the range of validity booklet.

DISCOVERY MACHUPICCHU reserves the right to cancel any trip, including a trip guaranteed at any time prior to departure due to terrorism, natural disasters, political instability or other external events which make it unviable for the company to operate our schedule the tours. If Peru Ver cancels a group trip on which you are holding a reservation for a full paid you can choose between an alternative trip or a full refund. The Company is not responsible for incidental expenses you may have incurred as a result of your booking such as visas, vaccinations, non-refundable flights or loss of enjoyment. If the alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the difference price. If the alternative route is chosen is of a higher value that you will pay differenced to the price.

Note: scheduled airlines may impose 100% cancellation charges.

8. Cancellation by you

If the client wishes to cancel, cancellation charges will be imposed. These are calculated from the day a written notification is received by TOUR GUIDES  MACHUPICHU.

The charges are:

60 and more days before departure: 50% of total (initial payment + local payment)

59 to 30 days before departure: 60% of the total price (initial payment + local payment)

29 days to 14 days before departure: 90% of the total price (initial payment + local payment)

Less than 14 days: 100% of the price (payment + local payment)

We strongly recommend hiring a cancellation insurance at the time of booking as this will cover cancellation charges in certain circumstances. (Note: This insurance does not cover a change of mind.).

9. Unused services and additional costs

There will be no discounts, postponing the tour or monies refunded for lost or unused services, this includes voluntary or involuntary termination, which means Illness, death of a family member, or others.

DISCOVERY MACHUPICCHU is not responsible for additional expenses as hotel accommodation, additional meals, additional transportation costs, and others. As a result of unexpected changes in your trip due to a change in the schedule of airlines, flight cancellation, conditions adverse weather, war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, epidemics or health risks.

10. Complaints

If the customer has a complaint about any of the tour arrangements, it is a condition of the contract that you tell our local representative at the time. If not complain at that moment in time we are denied the opportunity to investigate and fix the problem and therefore make Vista Peru not to accept any responsibility. If the customer has a dispute with Peru Ver TOUR GUIDES MACHUPICCHU is unable to resolve, please contact us within 28 days of your return and we will investigate further.

11. Travel insurance and cancellation

Travel insurance is highly recommended for all customers booking a tour with DISCOVERY MACHUPICCHU and we advise a minimum coverage of $ 75,000 that will cover personal injury, medical expenses, repatriation expenses, evacuation expenses, cancellation and restriction. It is our policy to verify the validity and coverage of your insurance policy and have the right to refuse travel to anyone whose insurance does not satisfy these criteria. If you choose not to purchase travel insurance, you will be asked to sign a way to acknowledge your acceptance that insurance was recommended but you refused and in case the need for change or cancellation of your tour or if you have to incur expenses such as medical expenses, the customer is responsible for all such additional costs.

12. Medical Form

For insurance purposes all clients over 70 years of age or older, or younger people with pre-existing medical conditions are necessary to complete our Peru Ver Medical Form must be signed and dated by a medical practitioner and sends us later than 30 days before the start of your tour. In the event that the customer has made the booking with the Company and subsequently is unable to complete the required medical form for any reason within 30 days before the start of his tour, the Company reserves the right to treat the booking as canceled by the date of notification and charges will apply for cancellations.

13. Financial Security

TOUR GUIDES MACHUPICCHU is a travel agency of the Ministry of Tourism Accredited and registered as a limited company under the Ministries of Tourism Board of Peru. Credit to the Ministry of Tourism requires full liability insurance and bonding so complying with all laws relating to international travel activity. GUIDES MACHUPICCHU fully complies with current European regulations regarding the protection of the money of the client.

14. Customers responsibility

Customers agree to accept the authority and decisions of employees GUIDES MACHUPICCHU, tour leaders and at the same time traveling agents withGUIDES MACHUPICCHU. If in the opinion of this persons the health or conduct of a client at any time before or after the game seems to endanger the safety, comfort or progress of a happy tour, then the client may be excluded from all or part of the tour. In the case of ill health, Vista al Peru can arrange, as seems fit and recover the costs thereof from the client. If a Customer commits an illegal act, he / she may be excluded from the tour and Peru Ver will cease to have responsibility to / for them. If you are affected by a condition, medical or otherwise, that might affect other people’s enjoyment or active participation of the tour, must report at the time of booking and indicate on the form of Peru Ver medica. No refunds will be given for unused services if excluded from a trip to any of these reasons. Customer shall at all times strictly comply with the Laws, customs, and foreign exchange and drug regulations of all countries visited.

Clients must be in possession of, and are responsible for the organization of a valid passport, visa where applicable, and certificates of vaccination required for their travel. Your passport must be valid for 6 months after your return date. The customer is also responsible for all visas, permits and certificates including vaccination certificates and insurance policies required for an entire journey. The client accepts full responsibility for obtaining all documents and permits, and is solely responsible of the adverse consequences arising from missing or defective documentation. Any information or advice given by the Company regarding visas, vaccinations, climate, clothing, baggage, special equipment, and others. Is given in good faith but TOUR GUIDES MACHUPICCHU can not be held responsible for any of this information and the Company shall not be liable for any errors or omissions in the information provided. To expedite the issuance of travel documents LOCAL GUIDES MACHUPICCHU note that all documents related to tourist travel such

as checks, itineraries and invoices will be sent via email.

15. Our responsibilities

Clients bookings are accepted on the understanding they appreciate the possible risks inherent in adventure travel and conducting visits, excursions or expeditions, appears in our programs at their own will. It is also important to understand that the most meticulously planned arrangement can go wrong. After all, South America is a continent underdeveloped in terms of basic infrastructure is concerned. Conditions are such in one of the tours that may be occasions when delays, discomforts or unforeseen circumstances occur. DISCOVERY MACHUPICCHU can not accept complaints due to these aspects.

a) When the client does not suffer personal injury, the company accepts responsibility for any part of the tour arrangements, booked Peru Ver, not delivered as described in the itinerary. b) When the client suffers death or personal injury as a result of an activity forming part of the tour arrangements booked with Vista Peru, DISCOVERY MACHUPICCHU accept responsibility if there is no fault on the part of the view of Peru or its suppliers and the cause was the clients fault, the action of someone outside the tour arrangements, or one that neither Peru nor see their suppliers could have anticipated or avoided even with the exercise of all due care.

c) The acceptance of DISCOVERY MACHUPICCHU of liability to pay compensation under Sections 15 (a) and 15 (b) is limited, in the case of air travel, rail travel, sea travel or accommodation in a hotel, the amount set out in the provisions of, respectively, the Varsovia Convention modified by De La Haya Protocol 1955, the Berne Convention 1961, the Athens Convention 1974 and the Paris Convention of 1962.

d) The acceptance of DISCOVERY MACHUPICCHU of liability in clauses 15 (a) and 15 (b) is subject to assignment by the client to see Peru of the client’s rights against any agent, supplier or subcontractor of Vista Peru, which is in any way responsible for the unsatisfactory holiday arrangements or the client’s death or personal injury.

16. Liability Limits of Peru

DISCOVERY MACHUPICCHU, its employees, shareholders, officers, directors, successors, agents and assigns (collectively DISCOVERY MACHUPICCHU) does not own or operate certain entities which provide goods or services for your trip. Acquires transportation (by plane, bus, train, boat or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated companies DISCOVERY MACHUPICCHU).

All such persons and entities are independent contractors. As a result DISCOVERY MACHUPICCHU is not responsible for any negligent or willful act of any person or entity or any third person.

17. Flexibility

The itinerary provided for each tour is merely representative of the types of activities planned, and the company has no contractual obligation to strictly follow it. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to change without notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate and other unpredictable or foreseeable circumstances.

18. Flights / Delays

We can not accept any responsibility for any cancellations or delays of your flights, whether the cancellation or delay is caused by adverse weather conditions, rescheduling of the airline, airport authorities and / or the performance of air traffic controllers, mechanical breakdown or industrial action. In case of flight delays result in lost holiday time, no refunds are given by hotels or suppliers. Similarly, airlines do not offer compensation for flight delays. 19. Factors beyond the control of Peru Ver (majeure force)

20. Suppliers Conditions

Airlines, railways, coach and shipping companies and other suppliers have their own booking conditions or conditions of carriage, and you will be bound by these to the transport provider relevant or vendor. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other supplier, and are often also subject to various international conventions. Where appropriate, copies of these terms can be viewed at our offices,or at the offices of the relevant supplier.

21. Local Conditions

Customer acknowledges that he / she will visit the places where the political attributes, cultural and geographical present certain risks, dangers and physical challenges bigger than those present in our daily lives. 22. Errors and Omissions

Although the company has made a concerted effort to verify the accuracy of statements made at the present, the Company shall not be liable for any errors, omissions or intentional misrepresentation that may appear in this brochure or on our website.

23. Privacy Policy

We will provide your personal information and any personal information you provide in relation to persons whose travel arrangements have been requested by you, to suppliers and operators to enable the operation of the services requested by you. We do our best to protect your personal information.

24. Special Requests

Specific rooms for requests, such as adjacent or connecting rooms, bedding requests, smoking or non-smoking and diet should be advised at time of the reservation. Please note that every effort be made to secure your special request, however, cannot be guaranteed.

25. Prices and agreements

The quoted prices include program planning, management and operating expenses that are based on current exchange rates, tariffs and taxes. DISCOVERY MACHUPICCHU reserves the right to increase tour prices to cover increased costs, tariffs and taxes received after prices are published, and to reflect fluctuations in the currency markets. DISCOVERY MACHUPICCHU does not have the obligation of the costs involved in any program.

26. Immediate arrival

In programs where immediate check-in has not been included in the program price, Peru Ver request that hostels do everything possible to facilitate this service, however, is not guaranteed. Most hostels allow check-in to be held in mid-afternoon. If you want your room ready for immediate use on arrival; DISCOVERY MACHUPICCHU can arrange this for an additional charge.

27. Activate the programs

In programs that are specified visits are made active or some elements of active visits. To enjoy these programs as intended, a minimum level of fitness is required. The required level would be equivalent to what is obtained by the daily exercise such as golf, running, brisk walking, tennis. Activities during the program may include (but are not limited to) hiking, off-road activities, walking on uneven ground or steep cobbled streets, horse riding, cycling, activities taking place at high altitude, off-road mountainous driving and navigating uneven terrain. DISCOVERY MACHUPICCHU, therefore, will require notice if a participant has a physical or other disability or may create a danger to him/her or other members of the tour. If the minimum level of fitness is not possible for the program selected, Vista al Peru reserves the right to refuse to accept anyone on the trip. DISCOVERY MACHUPICCHU also reserves the right to remove from the trip, by the participant himself, anyone whose condition is such that could create a danger to him/herself or others, or otherwise impact the enjoyment of other passengers on the trip. If you have any questions or need any clarification about a specific tour, please ask for details at time of booking.

28. Child Policy

In all programs, unless otherwise indicated, the maximum age of a child is 11 years and 11 months. 12 years of age or older are considered adults and will be subject to adult rates.

29. Photography during the Trip

DISCOVERY MACHUPICCHU reserves the right to take photographs during the operation of any program or part of them and use them for promotional purposes. When booking a DISCOVERY MACHUPICCHU program, program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are asked to identify themselves to their Tour leader at the start of the program.

30. Late bookings

For any bookings made within 15 days of departure, there will be a USD $ 100.00 fee charged to file. This last minute booking fee covers our additional costs for couriers, communication and administration.
